What is the possible federal sentencing for 2 counts access device fraud and 1 count aggravated ID theft?

We are just wondering what sentencing she could possibly get and what we should do for the child. She has 2 counts access device fraud and 1 count identity theft.

IS there a way to find out who is living at a address?

if a warrant is issued and then the DA Finds out that your not guilty can he have it quashed right away?

Is it Illegal & Considered “Identity Theft” if someone just temporarily “borrows” another’s identity?

For example, if a person with no SSN uses a relatives name and SSN to buy a Prepaid Direct Deposit Cash Card to verify Paypal & so that family/relatives/friends, can easily send them money as needed?

Suppose that this person is in this country on an extended vacation & wants to sell on eBay some of the stuff they bought. Since they don’t have an SSN or US bank account to verify Paypal, can they set up an eBay/Paypal account in their relatives name, and use their SSN to buy a “No ID required(except for SSN) prepaid Direct Deposit ATM cash card” to verify their account, and get money.

If there is no intent to defraud, or actions to that effect (like applying for credit cards & running up huge bills then defaulting on payments) then is it considered identity theft & is it a crime?

Does anybody have any information on pressing charges against someone for theft?

Why is dumpster diving illegal (in the USA), when our consumerism wastes so much good stuff?

Ok besides the @ssholes who go into it for information gathering to rip off people (like ID theft), the other side of dumpster diving is for free stuff even eatable food. I will admit that a lot of people throw away working computers by sitting them beside the trash been so it only makes sense that someone re-uses them instead of sending the toxic materials to go in a junk yard.

I feel this is a huge violation of my rights and I had to go to court several times to get it off.

I was careful to never have my address on the internet until I bought a house. I believed this would be kept at the county building, but it was posted on the internet for anyone to google.
Let me explain that I was a victim of a violent crime in the past and the criminal was getting out of jail, so I ferquently checked myself on the net, so this person would not find me.

After the county did this I had to go to court to get it sealed, and it took many months. Now I will have to transfer my house to a LLC to protect myself.

Let me stress, I don’t care if the police or government knows about me, I just don’t want criminals and id thefts people knowing my address.
I would like to know how I could change the laws so this will not happen to anyone again.

How safe is Blockbuster? Their forms require a name, address, credit card number?

Well, I don’t really understand why Blockbuster does it. Libraries rent books all the time, and yeah, some people steal from them. But the library card form doesn’t ask for CC info.
