This is the question the Supreme Court is looking at.

It will matter when they get busted for fraud and all the damages that was caused while purporting that fraud, And could possibly enter into Federal charges.

Lol, it does’nt matter to the store..or whateve company who accepts the phony I.D………….as for the person using the phony i.d…it all depends on if they/he/she/it has conscience or and/ if by using that other perons, i.d….if that person whose i.d. is being used will be a victim later to Identity theft….
I guess…it all depends in the mind of the criminal..the one using the fake i.d. if he or she is a dirt bag piece of guttar trash cowardace…just some piece of crap taht no one will notice should he/she be hit by a train and disappear

Perhaps for sentencing. There are many offences that are of greater or lesser degree because of the intent of the perpetrator.

How on earth could they not know the numbers belonged to a real person. What a good excuse for Id thieves to use “I didn’t know it belonged to a real person.”

the illegal alien is a criminal. He should be in prison and then deposited. ID theft is wrong and everyone knows it. There was no excuse

Well sort of, I think, because they’re charging him with identity theft, which is usually reserved for people who steal from others by assuming their identity. He wasn’t trying to steal from anyone, so I think he should be charged with something else. But yeah that’s just stupid. I can’t believe the supreme court is wasting their time with this.

I can’t believe I’m siding with the government on something. All ID theft should be punished severely. They put victims through hell. It doesn’t matter if they know the phony ID belongs to someone. They KNOW they are breaking the law.

I’m angry that they are even having to decide something like this. Hopefully this is a no-brainer for the SC. It doesn’t matter if they know whose ID it is. They know they are committing a crime and that’s what matters.

this is crazy. This shouldn’t even be an issue. It’s wrong to STEAL an ID. NAIL THE GUY!
